US trademark registration

File your brand name with the USPTO. The brand name gets registered. Without this, US customs can seize your branded goods at the port of entry.

USPTO fees are set by the US government and not negotiable. Legal fees vary by complexity of the search and prosecution.

Timeline

You can use the "TM" symbol next to your brand from the day you file. The "®" symbol is reserved for fully-registered marks (after issuance).

What we need from you

If you have multiple brands, we file each separately.

Common mistakes we avoid

Filing in the wrong class

Trademark registrations are class-specific. Class 25 is clothing; Class 21 is housewares; Class 20 is furniture. Wrong class = no protection for your product.

We do a class search before filing.

Filing only one class when product spans multiple

A furniture manufacturer might need Class 20 (furniture) AND Class 24 (textiles, if they make upholstered furniture) AND Class 27 (rugs, if applicable). Filing only one class leaves gaps.

We map all relevant classes based on your product mix.

Filing without a specimen of use

USPTO requires proof you're using the mark in commerce (a photo of the mark on product or packaging). Without this, the filing is rejected.

We collect specimens before filing.

Trying to register a Chinese brand directly

Chinese characters in a US trademark registration are possible but require specific search and examination protocols. We work with attorneys who handle both Latin and non-Latin marks.

When you don't need this service

If any of these apply, skip this service.

What you get back

We email you at every stage. You don't need to monitor the USPTO system yourself.

After registration

The registration is valid for 10 years. Between years 5-6, you'll need to file a Section 8 declaration of continued use (we can do this as a separate service).

You may also want to monitor for infringing marks (we don't include this in the base service; available separately).
